ChatGPT and the large cloud models are convenient, fast and powerful. But for entire sectors of the economy they are simply off-limits, or at least impractical. Not by choice, but because regulation requires certain data to never leave the organization's perimeter.
What the law says
Over the past two years the regulatory framework has become far more stringent, and it all converges in the same direction: traceability, control and data residency.
The EU AI Act (Regulation (EU) 2024/1689) requires high-risk AI systems to have end-to-end data traceability, documented human oversight and verifiable governance. Italy's Law 132/2025 introduces specific obligations for AI systems in healthcare: transparency toward patients, mandatory human oversight and criminal penalties for misuse. For Italian public administration, NIS2 and AgID qualifications effectively rule out a foreign cloud LLM for critical applications. GDPR, finally, requires specific legal grounds for any transfer of personal data outside the European Economic Area.
